Reggae Boy Jermaine Hue gets 9-month ban, team doctor given 4 years

The Disciplinary Committee of football’s world governing body FIFA has imposed a nine-month ban on Reggae Boy Jermaine Hue after he tested positive for a banned substance at a World Cup qualifying match.
In a statement a while ago, the local football authority the Jamaica Football Federation said the ban which will end on May 6, 2014 will forbid Hue from participating in any competition which covers all types of matches, including domestic international friendly and official or other sport related activity.
Hue, 35, a midfielder with Harbour View Football Club, tested positive after Jamaica's 2-0 loss against host Honduras on June 11.
Meanwhile, team doctor Carlton Fraser has been declared ineligible for a period of four years until August 6, 2017.
Fraser will not be able to participate in any competition or other sport related activity.
Fraser was banned for administering the drug, dexamethasone.

The player has been declared ineligible for a period of 9 months after testing positive for dexamethasone, a substance included on WADA’s 2013 Prohibited List. The team doctor has been declared ineligible for a period of 4 years after having administered the above-mentioned prohibited substance to the player. By testing positive for a prohibited substance, the player has violated article 6 of the FIFA Anti-Doping Regulations, and by administrating the prohibited substance to the player, the team doctor has contravened article 13 of said regulations. As such, both have contravened article 63 of the FIFA Disciplinary Code. The suspension periods will last until 6 May 2014 (for the player) and 6 August 2017 (for the doctor), the provisional suspensions imposed on the player and the team doctor by the chairman of the FIFA Disciplinary Committee having been taken into consideration. This suspension covers all types of match, including domestic, international, friendly and official fixtures.

This seems really excessive for Hue. Does the ban affect his local club duties as well? Yes, he is suspended from all football playing for the entire 2013-2014 RSPL season. I wonder if he is allowed to coach or work on his coach badges.

As Jamaicans we should not sit silently and let the nine-month ban on Jermaine Hue just slide. If Hue is an unknowing victim, then the JFF should step up and seek a date with FIFA to bring some clarity as to why Hue was unjustly punished.
Although some may not believe that Hue belongs in the national team, the foot balling quality that this homegrown talent has demonstrated over the years is something all Jamaicans can be proud of. His ability and talent is evidence that gives credit to the argument of home grown players vs foreign players...anyway that is not where we are going with this.
There needs to be a national outcry to protect our players and all our athletes from future abuse by professionals hired to assist them at all levels...schools, clubs and national teams. We as the public enjoy, cuss and demand a lot from the players and we believe that we should equally stand behind them when they are treated unjustly. We saw the effects of the “TUFFY” protest. It is just the proper thing to do.
Now Mr. JFF. If Hue gets punished you should also be punished. It is your responsibility to properly examine your employment procedures to be sure that this does not happen. If the player was unknowing as to what was going on, then the blame MUST fall squarely on your shoulders as you are also there to protect them, not just to use them. You were the one providing them with the support personnel. It was not the choice of the player. Do you see how unfair this all is to HUE?
We are publicly calling on Captain Burrell and his administration to do what is right and defend this fellow Jamaican. It is because of the mistake and incompetence of one of your staff that Hue is being used as a sacrificial lamb taken out to slaughter. Mr Burrell, you should not just apologize to Hue but to us as a nation, the same way you call on sponsors to support your team and us the public to support your games.
Captain Burrell, now is the time to show the nation that you are true and loyal to our players if they are wronged. As the head of our football program, this is an opportunity to show that you will defend them. That is what a true leader should do.

Frankly speaking the JFF is ultimately responsible for the outcome of affairs.
This has nothing to do with making a statement to local track and field, even though the media spin would like to use this and smear our track program's credibility.
What this ultimately is about, is a JFF employee unknowingly administering a banned substance to a national player. I say unknowingly because it is clear the doctor knew of the effects of the substance but did not know of whether it was a banned substance. There in lies the real issue.
The consequence of these actions are a 9 month and 4 year ban respectively. The victim of which is a Mr Hue. Now according to the little i know, the JFF is vicariously liable for the actions of the good doctor and should compensate Mr Hue for the loss of earnings. Additionally he if he so desires may bring a suit against the JFF for damage to his reputation as a result of this fiasco. Which he will likely succeed.
The best thing the JFF can do is try to have the ban overturned however even if it succeeds in this they will still be responsible for tarnishing his name. Thus still liable in a court of law.
Frankly speaking if i were to say anything to Mr Hue, is get your lawyers involved, even if you don't have one, get some very good ones, because one thing i do know. When all is said and done, your name is one of the most important things you will have in life. Your reputation precedes you in all things you do, it is that which can make doors open or close when money can not do those things. I for one value my credibility and i suggest he takes this seriously as what has occurred is a major blight on his character. All at the hands of the JFF.
They may try and throw hue and the dr under the bus but they would be more than disingenuous to do so. For this alone the current president should remove himself from office.

Jermaine Hue and his team are now weighing their options as the reality of a nine-month ban from football sinks in, but one thing is certain; the 35-year-old Jamaica and Harbour View midfielder is not ready to call time on his career.
Hue was on Thursday suspended by the FIFA Disciplinary Panel until May 6, 2014, after the banned substance dexamethasone was found in his system, after Jamaica's World Cup Qualifier against Honduras in Tegucigalpa on June 11. FIFA also announced that Jamaica's team doctor Carlton Fraser was suspended for four years by the panel for administering the substance.
If the suspension holds up, Hue, who has played 42 matches for the Reggae Boyz since 2002, will return just ahead of his 36th birthday.
No retirement
However, the midfielder's uncle and manager, Michael Hue, is certain that retirement is not an option for the former Kansas City Wizards and Mjallby player, even as they move to examine whether or not they are in a position to appeal the suspension.
"Knowing him (Jermaine), he has been through a lot of trying times even in terms of representing his country, we all know the ordeals but he has a strong mindset," Michael Hue said.
"I don't think he would find it too difficult to not play football for a year and come back because his style is not based so much on a physical type of play, his play is centred around skill, technique and a good passing game and he won't lose that technical ability," he added.
Hue is said to be shocked and devastated by the news, which came to him while he trained on Thursday, in the hope that he would soon return to the football field.
"He is shocked and devastated," Michael Hue added. "He is very disappointed in the nine-month ban. It will take time for him to come back to his normal self but there is a strong family support."
"We are going to look at the transcript in terms of what FIFA has said and see what can be done as it relates to an appeal. We will be sitting with the lawyers and the executive of Harbour View Football Club to see what's the process in terms of an appeal," Michael Hue added.

"Jermaine (Hue) is shocked and devastated," said the Harbour View Football Club (HVFC) talisman's manager and uncle Michael Hue. "When he heard the news, he was actually in training because he was hoping to be able to play in a short time. "He is very disappointed in the nine-month ban. It will take time for him to come back to his normal self, but there is a strong family support," added the older Hue. For the time being, the Hues expect to meet with the HVFC hierarchy and their lawyers in the coming days to determine their next move, as they contemplate an appeal and perhaps a bit more. However, the player's manager, who believes that the midfielder will return to play once his ban expires, is now concerned that the midfielder is now left with a damaged reputation and no means to support his family and himself due to no fault of his own. He is also hoping to be able to discuss the matter with the Jamaica Football Federation (JFF). Complained about fatigue "In terms of the verdict, a nine-month ban for the player; if you remember they had three matches in a short space of time ... Jermaine went to Honduras and complained about fatigue and was given the medication by the JFF's team doctor ... the doctor is employed to the football federation and it could have happened to any of the players there," Michael Hue said. "I was just wondering that with this doctor being an employee of the federation, what would the federation's stance be? "Jermaine Hue will now have to join the unemployment line. Who is going to compensate Jermaine Hue for the nine months that he is going to be without a job?" He has kids to send to school, a family to support, and bills to pay like any normal person. I'm hoping that in the coming days we will get a chance to raise these in a meeting, and I don't speak for the Harbour View Football Club, but I know that they would also raise the question with the loss of their marquee player," added Michael Hue. "If the doctor was in the employment of the federation then he was responsible for all the players on tour, and so the JFF, who was instrumental in getting the process expedited, must now come into question in terms of the way forward as it relates to Jermaine not being able to earn," he further noted. Jermaine Hue has featured in 42 matches for Jamaica's senior team, scoring 12 goals.

Ites, we need to step up the pressure on the JFF to speak up on the matter. If Hue was unaware of the legality of the drug being administered, then it is totally wrong for him to be punished to the extent that they have given him. We need the full story from the JFF and to hear it from them if Hue was told of the risk.
Think about it, it could have been any player on the team. We need to hear more from the JFF. USE your voice

Need to hear from the Bush doctor! Remember players bear some responsibility. If Hue didn't knowingly take the banned substance, then the ban should be reduced, and JFF pick up the lost wages.

The JFF remains silent on this. It leaves me to believe there might be some legal preparation in progress.
To Jerry Hue, I will say that many people are supporting you and if you did knowingly take the substance then you should also speak up and come clean with the public.
